Terms of Service

Please read these terms carefully before using our platform

1.

Acceptance of Terms

By accessing or using Halal Platform ("Platform", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, merchants, and others who access or use the Platform. By using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Our Platform is designed to serve the Muslim community with Shariah-compliant e-commerce solutions. By using our services, you also agree to comply with Islamic business ethics and principles as outlined in these Terms.

2.

Eligibility

To use our Platform, you must:

1. Be at least 18 years of age, or the legal age of majority in your jurisdiction 2. Have the legal capacity to enter into a binding agreement 3. Not be prohibited from using the Service under applicable laws 4. Provide accurate, current, and complete information during registration 5. Maintain the security of your account credentials

Merchants must additionally: - Hold valid business licenses where required - Comply with all applicable local, national, and international laws - Only sell products and services that are halal (permissible under Islamic law) - Provide accurate product descriptions and pricing

3.

Account Registration

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for: - Safeguarding the password used to access the Service - All activities that occur under your account - Notifying us immediately of any unauthorized use of your account

We reserve the right to: - Refuse service to anyone for any reason at any time - Terminate accounts that violate these Terms - Remove or edit content at our discretion

4.

Acceptable Use

Our Platform operates on the principle of halal-only commerce. This means:

HALAL POLICY:

All products and services offered through our Platform must be: - Permissible (halal) under Islamic Shariah - Free from haram (forbidden) elements - Truthfully represented and described - Compliant with our Islamic ethics guidelines

Our Shariah Advisory Board, led by qualified Islamic scholars, reviews and guides our policies to ensure compliance with Islamic principles.

Users agree to: - Conduct business in an honest and transparent manner - Avoid deception, fraud, or misrepresentation - Respect the rights and dignity of all users - Use the Platform only for lawful purposes - Not engage in gharar (excessive uncertainty) or maysir (gambling) - Avoid riba (interest-based transactions)

5.

Prohibited Content

The following products and content are strictly prohibited on our Platform:

HARAM PRODUCTS:

- Alcohol and intoxicants - Pork and pork-derived products - Non-halal meat and meat products - Gambling and lottery products - Interest-based financial products - Adult content and pornography - Weapons and ammunition - Drugs and controlled substances

INAPPROPRIATE CONTENT:

- Content promoting violence or terrorism - Discriminatory or hateful content - Fraudulent or deceptive content - Content violating intellectual property rights - Spam or malicious content - Content promoting un-Islamic practices

Violations of these prohibitions will result in immediate account suspension and potential legal action.

6.

Payment Terms

All financial transactions on our Platform are conducted in accordance with Islamic finance principles:

RIBA-FREE TRANSACTIONS:

- We do not charge or facilitate interest-based transactions - Late fees, if applicable, are calculated based on actual costs, not interest - Payment plans are structured as murabaha (cost-plus financing) or similar Shariah-compliant methods

PAYMENT PROCESSING:

- Payments are processed through Shariah-compliant payment gateways - Merchants receive payments according to the agreed schedule - Transaction fees are transparent and disclosed upfront

REFUNDS AND DISPUTES:

- Refund policies must comply with Islamic principles of fair dealing - Disputes are handled according to our Islamic dispute resolution process - We encourage amicable settlement (sulh) between parties

7.

Intellectual Property

The Platform and its original content, features, and functionality are owned by Halal Platform and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

YOUR CONTENT:

- You retain ownership of content you submit to the Platform - By posting content, you grant us a license to use, modify, and display it - You represent that you have the right to grant this license

OUR CONTENT:

- Our trademarks, logos, and service marks may not be used without permission - You may not copy, modify, or distribute our proprietary content - API usage is subject to our Developer Terms of Service

Limitation of Liability

To the maximum extent permitted by applicable law:

DISCLAIMER:

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding: - The reliability or availability of the Service - The accuracy of information provided - The security of data transmitted

LIMITATION:

In no event shall Halal Platform, its directors, employees, or agents be liable for: - Indirect, incidental, special, or consequential damages - Loss of profits, data, or business opportunities - Damages exceeding the amount paid for the Service

EXCEPTIONS:

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability is limited to the maximum extent permitted by law.

9.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

- Breach of these Terms - Violation of our halal-only policy - Fraudulent or illegal activities - Harmful content or behavior - Non-payment of applicable fees

Upon termination: - Your right to use the Service will immediately cease - We may delete your data after a reasonable period - Provisions that should survive termination will remain in effect

You may terminate your account at any time by: - Contacting our support team - Following the account deletion process in your settings - Settling any outstanding obligations

10.

Dispute Resolution

We encourage resolving disputes through Islamic principles of mediation and arbitration:

SULH (AMICABLE SETTLEMENT):

We first encourage parties to resolve disputes amicably, following the Quranic guidance: "And if two parties among the believers fall into a quarrel, make peace between them" (49:9).

TAHKIM (ARBITRATION):

If amicable settlement fails: - Disputes may be submitted to Islamic arbitration - Arbitration will be conducted by qualified arbitrators familiar with Islamic commercial law - The arbitration decision shall be final and binding

GOVERNING LAW:

These Terms shall be governed by the laws of Tunisia, without regard to conflict of law provisions. However, we strive to ensure our practices comply with Islamic commercial principles.
